Terms & Conditions - AXLROD (User)

1. Nature of Platform

AXLROD ("Platform", "Company", "We", "Us") is a technology-based intermediary under applicable Indian laws.

The Platform facilitates connections between users ("User", "You") and independent third-party service providers ("Partners").

AXLROD:

  • Does not employ Partners
  • Does not directly provide services listed on the Platform
  • Acts solely as an intermediary marketplace

2. Eligibility

By using AXLROD, you confirm that:

  • You are at least 18 years of age
  • You are legally capable of entering into a binding contract under Indian law
  • All information provided by you is true, accurate, and complete

3. Account Registration & Security

  • You are responsible for maintaining confidentiality of login credentials
  • You agree to accept responsibility for all activities under your account
  • AXLROD reserves the right to verify user identity at any time

4. Service Flow

  • Users may request services through the Platform
  • A Partner may accept or reject the request within a specified time
  • Once accepted, the service is fulfilled independently by the Partner
  • AXLROD does not control execution of the service

5. Pricing & Fees

  • Prices may be:
    • Dynamically generated (based on demand/supply)
    • Predefined (fixed pricing)
  • The Platform may include:
    • Service fees
    • Convenience charges
  • Final pricing will be displayed before confirmation

6. Payments

  • Payments are processed through RBI-compliant payment gateways
  • AXLROD may:
    • Temporarily hold funds (escrow-like mechanism)
    • Release payments upon service completion or as per policy
  • You authorize AXLROD to:
    • Collect payments on behalf of Partners

7. Cancellation & Refund Policy

  • Before acceptance: Free cancellation
  • After acceptance: Cancellation fee may apply
  • Refunds:
    • Subject to internal review
    • Processed within a reasonable time frame
  • Abuse of refund policy may lead to account suspension

8. User Responsibilities

You agree NOT to:

  • Provide false, misleading, or fraudulent information
  • Misuse or attempt to exploit the Platform
  • Harass, abuse, or harm Partners
  • Engage in illegal activities using AXLROD
Violation may result in immediate suspension or legal action

9. Interactions with Partners

  • Partners are independent contractors
  • AXLROD does not guarantee:
    • Service quality
    • Timeliness
    • Safety or outcomes
Users are advised to exercise reasonable caution

10. Limitation of Liability

To the maximum extent permitted by law, AXLROD shall not be liable for:

  • Acts, errors, or omissions of Partners
  • Service quality or failure
  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or goodwill

11. Indemnification

You agree to indemnify and hold harmless AXLROD, its directors, employees, and affiliates against:

  • Claims arising from misuse of the Platform
  • Violation of these Terms
  • Breach of applicable laws

12. Intermediary Safe Harbor

As per Section 79 of the Information Technology Act, 2000:

AXLROD acts as an intermediary and is not liable for third-party information, data, or communication hosted on the Platform, provided due diligence is followed.

13. Suspension & Termination

AXLROD reserves the right to:

  • Suspend or terminate accounts without prior notice in cases of:
    • Fraud
    • Policy violations
    • Legal non-compliance

14. Privacy

Use of the Platform is also governed by our Privacy Policy, which explains how user data is collected, used, and protected.

15. Modifications to Terms

AXLROD reserves the right to update these Terms at any time.

Continued use of the Platform constitutes acceptance of updated Terms.

16. Governing Law & Jurisdiction

  • These Terms shall be governed by laws of India
  • Courts in Nagpur, Maharashtra shall have exclusive jurisdiction
